They probably screwed me over.

Anyway I was just wondering if this is considered "defective merchandise." Today I went to FYE and bought a dvd. When I opened it, there were two cds that weren't properly placed into their holders. The cds were in the case, but if you tilted the case, you could hear the cd move inside. This resulted in two of the three cds being scratched. Plus one of the cases is like scratched.

As I stated in the beginning, I probably got screwed over, but I still wanted to know. Still.. I wanted to know if this counts as "defective merchandise."

Sounds like defective merchandise to me. I'd return it.

It counts. Every little tiny scratches on dvds/cds/vcds could improvice the quality of the things inside.
